Terms of Service

These Terms of Service ("Terms") govern your use of EmailMachine ("Service"), operated by EmailMachine ("we", "us"). By installing or using the Service, you agree to these Terms.

1. Description of Service

EmailMachine is a Shopify application that automatically sends transactional emails to a merchant's customers in response to order events. The Service sends order confirmation emails and shipping notification emails only. No promotional or marketing email campaigns are supported.

2. Acceptable Use

You may use EmailMachine only for its intended purpose: delivering transactional emails related to orders placed on your Shopify store. You agree not to:

• Use the Service to send unsolicited bulk email, spam, or promotional campaigns
• Attempt to circumvent sending limits or infrastructure protections
• Resell or sublicense access to the Service
• Use the Service in violation of any applicable law or regulation

3. Merchant Responsibilities

As a merchant using this Service, you are responsible for:

• Ensuring your email templates comply with applicable laws (CAN-SPAM, CASL, GDPR, etc.)
• Maintaining accurate customer contact information in your Shopify store
• Providing customers with a way to contact you regarding their orders

4. Billing

EmailMachine is offered as a paid subscription through the Shopify App Store. Billing is handled by Shopify via the Shopify Billing API. By subscribing, you agree to the applicable subscription fee charged to your Shopify account. You may cancel at any time from your Shopify admin; cancellation takes effect at the end of the current billing period.

5. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted service. We are not liable for delays or failures caused by third-party infrastructure, including Shopify or Amazon Web Services.

6. Termination

You may stop using the Service at any time by uninstalling the app from your Shopify admin. We reserve the right to suspend or terminate access if you violate these Terms or misuse the Service.

7. Limitation of Liability

To the maximum extent permitted by law, EmailMachine shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Service. Our total liability shall not exceed the amount you paid in the 30 days prior to the claim.

8. Changes

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
